§ 43-9. Sole source procurement.

  • A contract may be awarded without formal procurement when the Purchasing Agent determines, in writing, that there is only one source practically available for that which is to be procured. The writing shall document the basis for the determination. The Purchasing Agent shall also issue a written notice of the determination that identifies what was being procured, the contractor selected, and the date that the contract was or will be awarded. A record of sole source procurements shall be maintained that lists each contractor's name, the amount and type of each contract, a listing of the item(s) procured under each contract, and the identification number of each contractor file.
