§ 41-11. Direct hire by private persons.

Latest version.
  • A.
Subject to the regulations adopted under Subsection B, off-duty Deputy Sheriffs may provide police services to private persons and entities. Such deputies may receive compensation for such services, and such compensation will be paid by the private person directly to the deputy.
    B.
The Sheriff may adopt written rules regulating the off-duty employment permitted in Subsection A above.
[Legislative intent: Among other situations, this subsection applies when a private gathering desires to maintain a police presence. The Board recognizes that the deputy is off duty, because his salary is being paid by the private parties; but it also recognizes that with the deputy's uniform and police powers comes public responsibility. The Sheriff's rules should recognize this responsibility. They should also clarify the mechanism in which officers are to be paid so that payment is well-documented and creates no legal implications for the County.]
